The Municipality of Chatham-Kent is advising residents that York1 has formally withdrawn its court application related to local planning requirements for its proposed waste project in Dresden.
According to a media release issued Friday afternoon, York1 had filed the court application arguing that its proposed project did not require local land-use planning or zoning approvals from Chatham-Kent.
On Sept. 24, the municipality received a formal “notice of abandonment” of the court application from York1. It means that the company has ended this court application.
However, officials remind residents that the court case, originally scheduled for November, was not to be taken as the final determinate of whether York1 can proceed with its proposed landfill and waste processing project.
The court case would have only dealt with whether local zoning requirements apply to York1’s proposed project.
Chatham-Kent officials anticipate York1 will now proceed through the usual municipal planning approval processes, the release said. If York1 submits a planning application, it would be subject to the applicable municipal planning requirements and processes. This means that the decision would be subject to council’s approval.
Going forward, it means that future public meetings may be held, and that an appeal to the Ontario Land Tribunal would be available.
